by Administrator 23. February 2010 04:58

A charter bus carrying the Dixie State College mens baseball team was involved in a collision with a snowplow early Sunday morning.

The accident occured in the northbound lanes of Arizona State Highway 389 shortly before 6:00 a.m. The Red Storms baseball team was returning home from a four-game Pacific West Conference weekend series in Phoenix when a snowplow slowed to 10 miles per hour as a car on the right of the road came into view. The driver of the bus did not realize the plow was snowing and struck the vehicle from behind.

Trent Pratt, assistant coach of the Storms, said the bus driver "did all he could and did a great job in minimizing the damage." Pratt said the accident "could have been a lot worse."

Five student-athletes were transported to Dixie Regional Medical Center following the crash. All five were treated and released by 10:30 a.m.

Man Gets 25 Year Sentence for Fatal Arizona DUI Crash

by Administrator 16. February 2010 06:28

A man charged with driving under the influence in a 2008 car accident that left three people dead has been sentenced to 25 years in prison.

As a result of the single accident, 29 year-old Enrique Acosta, will face an additional 7.5 years in prison upon completion of his 25 year term.

Acosta was attempting to evade police in 2008 when he struck another vehicle. Officers observed the man showing signs of impairment along 51st Avenue in Phoenix. Police attempted to stop Acosta, who momentarily pulled over before leading the officers on a chase.

Running a red light on 51st Ave, Acosta collided with a car carrying five passengers. Of the five people in the vehicle, three did not survive. Mario Bonfil Martinez, Beatriz Guiterrez-Montoya, and Nancy Rosales were pronounced dead at the scene.

Tests showed Acosta's blood alcohol content to be .156 percent at the time of the crash, almost twice the legal limit in Arizona. He was charged with three counts of first-degree murder and two counts of aggravated assault, which he will serve simultaneously.

The effects of car crash injuries can range from simple inconvenience to a lifetime of pain and disability – both of which may be actionable under the law. Though taking legal action may not be your first though after a devastating automobile accident, doing so may be necessary to recover the costs of medical care, ongoing treatment, and lost wages.

Jury Awards $40M to Tucson Parents Following Boy's Death in DUI Crash

by Administrator 16. February 2010 06:19

The family of a Tucson boy killed by a drunk driver has been awarded $40 million by a Prima County jury.

Authorities say 14 year-old Jose Rincon Jr. and a friend were riding their bicycles in Tucson on January 12, 2008 when they were struck by a car. Rincon was killed in the accident and the other boy survived.

Prosecutors for Rincon's family succesfully argued that the city of Tucson was partially at fault for the accident due to the poor design of the road. The boy's parents also named the driver and Chuy's restaurant as defendants in the lawsuit. The driver was sentenced to 14 years in prison in 2009 and the restaurant, where the driver drank alcohol before the accident, settled with the boy's family for an undisclosed amount.

According to prosecutors, Tucson taxpayers will be responsible for about a third of the $40 million verdict, with the driver and restaurant sharing responsibility for the rest.
