Chicago Wrongful Death Lawsuit Results in $13.7M Verdict

A Chicago man has been awarded $13.7 million in a car accident lawsuit filed by the family of a BMW salesman who was killed in a high-speed crash that occurred while driving 90 mph during a test drive. Traveling 90 mph in a 45 mph zone, the BMW clipped another vehicle and hit a light pole, killing 22 year old Roger Czapski. Czapski, the car salesman, was seated next o the driver, 20 year old Christopher Maher. Maher survived with serious injuries. 

Maher denied any liability in the lawsuit, arguing that Czapski contributed to his own death by encouraging him to drive faster than the speed limit and never asking him to slow down. The test drive also violated the BMW dealership policy by going outside the established route. After a one week trial the jury returned a verdict of $13.7 million for the Czapski family.

Tire, Not Alcohol Caused Crash

The Mississippi Court of Appeals ruled this week that a fatal car crash was the result of a faulty tire, not alcohol. Travis Kirby, 20, was driving his Chevrolet Camaro nearly 90 mph on Highway 27 when the vehicle,according to court records, “left the road, rolled, clipped a tree, continuedto roll, hitting another tree, and then came to rest on its side.”

Kirby was killed instantly. Authorities said his bloodalcohol level was 0.25, more than three times the legal limit. RileyStrickland, 18, and Sidney Odom, 19, were both injured.

The court upheld a $2.1 million verdict against GoodyearTire and Rubber Co. and Big 10 Tire Co. Attorney for Odom, Mike Allred said thetire failure was “the direct cause of the accident…I’m very pleased that theCourt of Appeals followed the law and did the right thing in affirming thejudgement.”

3 Killed in DUI Crash

A drunk driving accident killed three in Manhattan Beach. At 12:30 a.m. on April 9 in Fullerton a drunk driver ran a red light and hit theMitsubishi Eclipse driven by twenty year old Courtney Stewart. Henry Pearson,25, Nick Adenhart, 22, and Stewart were killed instantly. The other passengerJon Wilhite, 24, is in serious condition.

Pearson’s father wants the driver of the mini van to bebrought to justice. “[My son] died in extremely tragic circumstances, but hehad the best life anyone could ever have. He lived life to the maximum, with noregrets.”

Crash Kills 2, Injures 1

An SUV crashed into a home on Thursday evening. Around 6:30pm, an SUV travelling 55 to 60mph in a 45mph zone crashed into a South 40th St house near Roeser Rd.

Two women were ejected from the SUV when it rolled over. They were both killed instantly. A third woman had to be extricated before being taken to a hospital in critical condition.

Importance of a Seatbelt

Many accidents are simply unavoidable.  They can happen in an instance.  Safety precautions can be taken to prevent an accident,  but sometimes it will still happen.

16-Month-Old Boy Run Over in Parent's Driveway

A 16-month-old boy was rushed to the hospital after being backed over by a car in his parent's driveway. The boy, Israel Otero, is being treated at the Phoenix Children's Hospital. His injuries include a lacerated liver, broken hip, broken leg, and fractured skull.

Police originally ruled the incident a hit-and-run but later determined it was just an accident. The accident occured Monday afternoon near Thomas Road and 63rd Avenue. Witnesses say the boy was playing in the yard when he was hit by a vehicle driven by a man who was buying a truck from the child's father, Daniel Otero. The driver saw the child but thought he had just fallen down. When the child's parents noticed his injuries they hurried to the hospital.

 Police questioned the driver and determined he was unaware he had struck the child. Though some neighbors doubt the driver's story, Israels father did not question the investigation. "If he said he didn't know my son was there, I believe him." Daniel Otero says.
