Strict Liability

In the average personal injury claim, the plaintiff needs evidence that the defendant committed a careless or negligent act. In some cases, however, this would not be a fair standard. For example, consider a person who has been hurt by a defective product. Determining the exact mistake that lead to the defect would require a level of knowledge – and access to a company’s records – that the average person does not have.

To help injury victims in circumstances like these, legislators developed a legal policy known as strict liability. According to strict liability, businesses and certain other parties have a duty to make sure their actions are safe to the general public. To learn more about our state’s strict liability laws and how they may apply to you, call the Phoenix strict liability lawyers of Haralson, Miller, Pitt, Feldman & McAnally, P.L.C. at 800-763-0964.

When Does Strict Liability Apply?

As a general rule, the standard of strict liability applies to persons or entities that could potentially endanger the community. Common examples include:

  • Manufacturers and retailers. Businesses can be liable for injuries they cause to customers even if they have not intentionally committed any negligent act. This is because it is their responsibility to make absolutely sure the products they sell are reasonably safe.
  • Dangerous activities. Anyone who conducts inherently dangerous activities in public is responsible for any resulting damage. For example, a person who sets off illegal fireworks in or near a public area may face civil suits filed by injured parties.
  • Dog bites. Arizona law applies the strict liability standard to almost any injuries caused by dogs or other pets. The only exception is when a person provokes an attack by hurting or harassing an animal; otherwise, it is the owner’s sole responsibility to prevent animal attacks.

If you have been hurt by a negligent party like those listed above, our Phoenix strict liability attorneys can help you determine if you have grounds for legal action.
